Spousal support, sometimes called alimony, is first ordered on a temporary basis. Once the divorce has been finalized, permanent support may be granted.

Temporary Spousal Support

Once the divorce is filed, a temporary order for spousal support may be granted. This order details the amount of spousal support, which determined by a formula. The courts use a computer program into which they enter numbers such as income and debt to determine the correct amount of temporary spousal support to award.

Permanent Spousal Support

Permanent spousal support is left up to the judge in the matter. The permanent amount is calculated pursuant to California Family Code Section 4320, which details the types of factors that are taken into account, such as the length of the marriage and the education of the spouse seeking support. The computer program that is utilized to calculate temporary support is never used to calculate permanent support, as it is prohibited by law.
